Personal Injury
The URTU Injury Compensation Scheme covers you if you have had an accident or contracted an industrial disease at work. It also NOW INCLUDES accidents not connected with work (if the injury results in absence from work).
URTU has an outstanding record in handling these cases; winning compensation for hundreds of members each year.
The Union does not provide compensation from its own funds but provides legal muscle for advising and pursuing industrial injury compensation claims through the courts. Such cases can take years to settle. The type of incidents dealt with ranges from simple, minor cases like a sprained ankle to complex situations resulting in death.
Eligibility for Personal Injury/Accident Compensation
- Scale A + BF, Scale A or Part-time (P) member.
- Date of membership must precede accident date ie. you must be a Union member at least one day before the accident. (Claimant must also maintain membership until claim is settled.)
- Contributions must be up to date (and not more than six weeks in arrears).
- Applicants must provide a full and honest statement.
- Proceedings must begin within three years from the date of accident.
Special notes
- Completion of the standard application form indemnifies URTU and its advisers against any claim by the member.
- Receipt or acceptance of a completed claim form does not mean that the Union can guarantee to take up the case. All applications are subject to assessment.
- Failure to take up a case, for whatever reason, will not give rise to a claim for damages by the member against the Union or their solicitors.
